Apologies in advance for what might look like a rambling diatribe going nowhere. But the one thing I know really well - better than almost anyone else - is boxing. And there’s a really valuable lesson from boxing that the Democratic Party needs to learn in a hurry.

I clerked for a liberal and a conservative federal judge, and came away with tremendous respect for both and how they arrived at their opinions. Even though you could guess how they were likely to rule on an issue, it never felt like an outcome drove their reasoning.
This Court is an embarrassment.

I wasn’t suggesting otherwise. I was pointing out that the statistic they’re flogging is as artificial as saying something like 90% of excess calories come from pizza if pizza is just a small part of someone’s diet.

It’s a hugely misleading statistic. If you deleted that entire segment of the economy, and didn’t replace it with anything else, we’d have basically flat GDP. But that’s not how the world works. All those people working on data center deals would have been selling something else.

They’re at least throwing sand into the gears. Don’t underestimate how important it is just to slow these assholes down. Yes, it would be great if SCOTUS wasn’t completely in the tank for Trump, but they can’t hear every case, and the district judges are doing their part to throw the brakes on.

Don’t get me wrong, writing appellate opinions is tremendously fun, and the work product is consistently excellent, but it’s basically the difference between storming Omaha Beach and writing an academic article about the impact of storms on Omaha Beach.

The district court docket is so much more challenging than appellate work. At any given time, you’ve got 500 active matters with a dozen substantive civil motions on calendar every week, not to mention criminal trials and sentencing.

Appellate judges hear a dozen cases every few months.

I’m biased because I clerked in the district court, but federal district judges as a group are the most consistently excellent group of lawyers in the country.

I worked for an appellate judge, too, and there are many great ones, but also a huge contingent of ivory tower arrogant tools.
