Citizens United held that government may not regulate a corporation’s right to spend obscene amounts of money in elections.

But the court did not define what a corporation is—it could not.

State Government can do that.

So, for example, NJ could rewrite its definition of corporate powers not to include political contributions. That would mean that a corporation that was chartered in, say, Washington State might do business here but wouldn’t be allowed to do any political spending here. 2/2
