Obama deported about 3 Million people without the abusive actions being applied by Trump.

You could triple the number of Immigration judges, & run true due process hearings 2 shifts/day, 7 days/week. 14 hearings instead of 5.

So, possibly deport 2-3 times as many as Obama without flagrant abuse

With Trump & Bondi’s public statements and releases, there is a very credible claim of selective & vindictive prosecution. Usually hard to get traction on such a claim.

Judge is likely to support intrusive discovery into DOJ internal communication to confirm or deny such.

This is an excellent argument that, even if James was actually guilty of intentional fraud, the penalty should simply be a fine 3-5 times of the “ill gotten” benefit.

Judge will never say it, but will probably be really pissed if the Govt does not push for a plea agreement along these lines.

The first hearing will reveal whatever the defense has to point at vindictiveness & abundant contrary, exculpatory evidence.

At that point, the judge could just dismiss the case and entertain defense request for sanctions.

Surmising from info in general press, the jurors might have only been presented the document they claim shows “primary residence” was checked off.

Legal, but incredibly stupid if they presented only that, knowing the existence of exculpatory info that is credible and more directly on-point.

It is also possible that if NY state views this as retaliation explicitly for doing her job, state might cover any legal fees she doesn’t get reimbursed by sanctions.

If discovery confirms claim by James’ atty (Abbe Lowell), i.e., just 1 single document had erroneous claim of “principal residence”; other docs were correct; she made communication to lender clarifying the error; & mortgage broker said they didn’t rely on error

Invoke the act very soon and, unless very isolated & restrained, see if the act allows Government to functio without any appropriations, whatsoever, until a bill is passed that includes declaration no funds can be expended for activities pursuant to implementing the Act.

Posted before, Blue state Govs & blue Govs in purple states will need to activate their own state Nat Guard (100% legally operating as law enforcers) on election day to guard polls & vicinity, vote counting centers & machines from Fed interference. No warrant, arrest & forcibly repel Feds.

It is not juror nullification if they look at the evidence & found it to be ambiguous or weak; & the Government’s witnesses (probably goons from ICE) as not truthful/credible.

Nullification is refusing to indict/convict, regardless of evidence, because they disagree with the law.

This is great documentation that if Trump invokes the Insurrection Act, his justification does not fit the conditions stated in that law.

And with the Supr Court having eliminated Exec Branch (Chevron) deference, Fed judges are empowered to intervene in cases that aren’t a close call.
