SCOTUS test for determining if a public official has “engaged in state action” under the First Amendment by deleting comments and blocking critics: 1) if the official had “actual authority” to speak for the government and 2) if the official “purported to exercise that authority” on social media.

Today the FCC accepted for filing the application for Nexstar (Fox31) to acquire TEGNA (9NEWS) and has set a pleading cycle (public comment) to run through late January with a ruling to follow. The FCC says Nexstar is requesting two ownership rule waivers.

On a personal note: Sen. Winter was an incredibly kind person. She always wanted to help. She often brightened my day at the Capitol.

She didn't shy away from tough questions and she was fierce in her beliefs. She was brave in coming forward in 2018 to report sexual harassment.
