Nothing is “always the case.” These traffic cops did an exemplary job. We should hope the same patience and grace are extended to all suspects.

Those cops gave him SO much extra leeway. If only they’d treat all citizens with that much patience and respect.
Under North Carolina law that’s considered error so severe the defendant doesn’t need to show prejudice at all. In a capital case, the defense may not admit guilt as a strategy without the client’s express consent on the record. The US Constitution is more permissive.

I once lost a case because the Court of Appeals said there was no error in the trial. There *was* error; I should have lost because the error was harmless.
I once played in a grand pause *at Carnegie Hall* during a Mahler 1 performance. It was pianissimo, so only my section heard it, but still, not great. BUT. One guy in my section loved to retell the story, and in his version, I crashed in double forte LIKE A SIMPLETON. It’s been 24 years; still mad.

It won’t work, but more power to him. Federal agents acting within the scope of their duties can remove their cases to federal court and assert a qualified immunity defense. Whether or not they have qualified immunity, they certainly can invoke federal jurisdiction.
