“Interpretive Facts: Textualism, Empiricism, and the Law-Fact Divide” is now available on SSRN! The article will be published next spring/summer, so I have lots of time to incorporate suggestions. 😊

A fascinating theory! You might yet wind up persuading me

Middle-aged white people (i.e. my demographic) need to hear that simply keeping your head down and staying out of trouble won’t work as long as DHS is in your city. They need, imo, to feel like getting ICE out of town is a personal safety issue. I think videos like this help make that case.

From the standpoint of optics & organizing, it’s really important that the Chicago agents are attacking and brutalizing white people. Not protesting students, either, but middle-aged middle-class white people doing their jobs.

Reading request! If you could recommend one text that explored the history of an idea/concept in a riveting and surprising way what would it be? Please re-skeet if you can. I know this is a niche ask.

U.S. District Judge April Perry says it comes down to a "credibility determination."

"I simply cannot credit [the Trump administration's] declarations to the extent they contradict state and local law enforcement. … DHS' perception of events are simply unreliable."

#BREAKING A federal judge say she will grant "in part" a request by the state of Illinois for a temporary restraining order against the deployment of National Guard troops into the state.

U.S. District Judge April Perry is still ruling and has not outlined the details of her order.

Please help me get the word out about the new websites for Legal Theory Blog and the Legal Theory Lexicon. Reposting here and on other social media sites is great. It would be especially helpful if law school faculty members could send an email to their colleagues with the new addresses.

Idk how these incidents look to people who live far from the cities where they happen. It’s clear that the president & many of his supporters are profoundly deluded about what’s going on. But if this is what the average nightly news viewer is seeing, I just don’t think ICE can win. I really don’t.
hkpmw.bsky.social
They’re describing this ICE attack the way they would ordinarily describe, idk, a carjacking or something. In other words, they are conveying to older suburban viewers like my grandparents that DHS is behaving violently and lawlessly. Which is correct, of course!
hkpmw.bsky.social
One significant thing about this video: this is WGN news. This is what my grandparents watched every night when they lived in the northwest suburbs. And although they’re not saying it outright, they are absolutely representing federal law enforcement as the bad guys.

Today my @nytimes.com colleagues and I are launching a new series called Lost Science. We interview US scientists who can no longer discover something new about our world, thanks to this year‘s cuts. Here is my first interview with a scientist who studied bees and fires. Gift link: nyti.ms/3IWXbiE
