"Mr. Comey is gratified by Judge Currie’s decision today dismissing the case against him. The decision recognizes that the case was brought by someone who had no authority whatsoever to be the United States Attorney. The decision further indicates that because the indictment is void, the statute of limitations has run and there can be no further indictment. The day when Mr. Comey was indicted was a sad day for our government. Honest prosecutors were fired to clear the path for an unlawful prosecution. Ms. James now moves to dismiss the indictment on the ground that Ms. Halligan, the sole prosecutor who presented the case to the grand jury, was unlawfully appointed in violation of 28 U.S.C. § 546 and the Constitution’s Appointments Clause. As explained below, I agree with Ms. James that the Attorney General’s attempt to install Ms. Halligan as Interim U.S. Attorney for the Eastern District of Virginia was invalid. And because Ms. Halligan had no lawful authority to present the indictment, I will grant Ms. James’s motion and dismiss the indictment without prejudice.

A federal judge ORDERS the disclosure of James Comey's grand jury minutes to the defense, citing a "disturbing pattern pattern of profound investigative missteps" and casting doubt on Lindsey Halligan's declaration about the gap in the record.

The Court recognizes that the relief sought by the defense is rarely granted. However, the record points to a disturbing pattern of profound investigative missteps, missteps that led an FBI agent and a prosecutor to potentially undermine the integrity of the grand jury proceeding. Therefore, in this case, “the Court has before it a rare example of a criminal defendant who can actually make a ‘particularized and factually based’ showing that grounds exist to support the proposition that irregularities may have occurred in the grand jury proceedings and may justify the dismissal of one or more counts of the indictment.” See Naegele, 474 F. Supp. 2d at 10 (citations omitted). Accordingly, the defense request for all grand jury materials is granted.

The D.C. Circuit blocked the probable cause finding, but not all proceedings into the matter.

Important to understand this. There's a reasonable chance that your Dem Senator who voted against it and is acting mad now was in on the play. It's the same reason why they scheduled the surrender for AFTER the election this week. They didn't want people pissed at Dems right before an election.
