But I know this can't possibly be the case because I've seen artists who worked in the games, entertainment, movie, and book industry include these sorts of clauses. In other words, people who should be quite familiar with the law since it relates directly to their profession.

I don't actually know what actual US law says regarding this issue. I've tried looking it up and yet I get mixed results in google. The reason I am asking is because some folks on twitter think "I'm the commissioner, I ordered the art, it's mine after I receive it. I can do whatever I want."

I'm talking about the clauses that say "The client has the right to published the commissioned piece wherever and the artist has the right to use the piece for promotional purposes. If the client wishes to profit off the piece, the commercial rights must be purchased from the artist." 🧵

(Please repost) So I have a question for professional artists on here. When you write up the publishing rights clauses in your ToS, do you make sure it adheres to the law? There's a big kerfuffle on twitter right now relating to this issue, and I actually don't know what the answer is. 🧵
