To make matters worse 8th Circuit Judge Duane Benton who was appointed by George W. Bush announced he would take senior status giving Felon47 the opportunity to appoint a loyalist as a replacement.
Also: We’re in the Eighth Circuit for this. This is a court of 10 active Republican appointees and 1 Democratic appointee. All of the senior status judges are Republican appointees as well.
So, a quick ruling could immediately be blocked, putting this—again—new case in a bad posture from the go.
