I have thought about this argument in the context of god-given rights. By definition, a right is a moral claim an individual has with the state to secure certain liberties. If there is no state, the rights are meaningless. If the state fails to uphold that claim, then the people need to overthrow it
It doesn't matter what the Constitution says. If the government can execute you on the street or in your own home on a whim, you have no rights. None.
