I didn’t intend to suggest said that, though I could have been clearer that I was being sarcastic. In light of his remarks during the Ninth Circuit, I was imagining how he might have reacted to the statement.

It’s stomach-churning to see district courts confront, very directly, the lies about their communities being told by the federal government, only to see appellate courts insist that they shut up and eat Trump’s shit sandwich of lies.

And atop it all sits SCOTUS, the greatest reality-denier of all.

It is pretty galling that the Supreme Court spent four years telling Biden "you can't do that without Congress" then allowed Trump to seize a once-unthinkable amount of power from Congress within nine months and concentrate law-making authority almost entirely in the executive branch.

The odds of anything like regular elections in 2026 is about 50/50, and far, far less than that for 2028.

The endgame for all of this is the violent neutralization of political threats to Trump, with election results being the most obvious.

And THAT is all driven by his fear of dying in prison.

Hamilton’s performance on behalf of the DOJ today in Chicago, combined with Judge Nelson’s horrifying remarks during the Ninth Circuit argument on the Portland appeal, make this a pretty bad day for the rule of law . . . and for the idea of truth generally in 2025.

If federal courts have no power to declare that the sky is blue when the POTUS says it’s rainbow (and that we thus have to use the 82nd Airborne to repel the gay invasion), we simply have no reason for a federal judiciary that does anything but put people in jail and resolve contract disputes.

This is responsible on Perry’s part. The more narrowly-tailored her injunction is — the more specific it is to things that actually have happened or that are known to be imminent — the more defensible it is on appeal. It’s not great lawyering to ask for the moon in this context.

You do not want to delve too deeply into Judge Ryan Nelson’s views, as expressed during today’s Ninth Circuit argument (he’s a Trump appointee).

His ANGRY insistence that the district court agree with (or at least not dispute) the executive’s claim that 2 + 2 = a banana was . . . very chilling.

I wouldn’t say it’s entirely incoherent. Government would, in fact, scarcely exist for those willing to conform their sexuality to the fundamentalist line, but the police power must exist to enforce that line. “Libertarians” always reserve police power to preserve their, you know . . . liberty.
