Technically, the initial attack was not a war action or combat per se, but rather an extra-juducial killing - murder - to begin with. Hegseth et al were just killing the surviving witnesses. All illegal acts. There are no legal scholars who can claim with any validity or basis otherwise.

Bombing civilians in boats without evidence of a threat is no different than if the Border Patrol started shooting people with backpacks approaching the US but still in Mexico. “The backpack probably had drugs and they were probably coming into the US” is not a legal rationale.
