Whether public pressure, or the threat of litigation from the applicant is what helped move the needle, but it appears that top agency official Vinay Prasad likes to make news, only to do so in a way which does not have truly meaningful impact, which is no small task. Can he keep doing so?

The thing is, the President has zero input into whether he “accepts” the results of the midterm elections or not. It’s not something the President has control of, or even has legal standing to challenge, so his opinion on the topic is completely irrelevant.

FDA is unable to simply “reject” something it previously said was OK, and the applicant has threatened litigation in accordance with the law, thereby forcing FDA to reconsider its uncharacteristically undisciplined denial.
