What options does Trump have if the Supreme Court rules against his emergency tariffs (as after yesterday's arguments seems likely)? I spoke to the The Associated Press about them here: apnews.com/article/tari...
Trump has other tariff options if the Supreme Court strikes down his worldwide import taxes
President Donald Trump has warned that the Supreme Court will leave the United States “defenseless’’ and possibly “reduced to almost Third World status’’ if it strikes down the tariffs he imposed this...

A majority of justices on the Supreme Court seemed skeptical of the legality of the IEEPA tariffs during oral arguments today. But I was surprised that one of the government's key arguments wasn't subject to more scrutiny.

As President Trump's sweeping IEEPA tariffs head to the Supreme Court, I argue in a new @lawfaremedia.org piece, that they are based on pretext.

The IEEPA Tariffs Are Based on Pretext
The U.S. trade deficit is not an “unusual and extraordinary threat.”

This spring, President Trump declared that the U.S. trade deficit in goods was a national emergency and enacted sweeping tariffs in response.

@stratospahis.bsky.social explains why the trade deficit should not be considered an “unusual and extraordinary threat."

I wrote a piece for The Lawfare Institute analyzing the Federal Circuit decision declaring Trump's emergency tariffs to be illegal.

The Federal Circuit Rules Trump Tariffs are Illegal
But its overly cautious ruling opens the door to more IEEPA tariffs in the future.

Hard to think of a more self-destructive prez action than the new tariffs. Simultaneously knee-caps our economy, destroys our credibility, undermines the institutions underpinning economic & geopolitical stability (which we built!) & pushes our allies into the arms of China. Utterly destructive.
