It literally grew out of the post-9/11 build up of the military. We ended up with so much extra shit, most of which even our allies were already over supplied with, that we "needed" something to do with it other than turning it into scrap metal. So we gave it to any police force that wanted it.

To be fair, chemical irritants are generally prohibited in war due to treaties banning chemical weapons...
