TL;DR: We have (to our knowledge) the first public data on how Trump-appointed judges act at sentencing. They’re less likely than others to grant leniency. Moreover, racial/ethnic disparities vary widely by president, and it’s not just about political party.
Interaction of defendant race and judicial appointment: probabilities and pairwise comparisons of sentencing deviations. Each panel shows estimated probabilities of judges deviating below or above sentencing guidelines for a given defendant racial group or appointing president (panel titles). Rectangles display probabilities (as percentages) as computed from statistical models. Edges connect appointing presidents whose probabilities differ significantly in pairwise comparisons, with non-significant relationships omitted. For example, in the bottom-left panel (White defendants, below-guidelines deviations), Obama appointees (37.8%) are significantly more lenient than George W. Bush appointees (31.0%), who in turn are significantly more lenient than Trump appointees (25.2%). The path connecting Obama to Trump through George W. Bush reflects that Obama appointees are also significantly more lenient than Trump appointees, with the direct edge omitted for visual simplicity.
