Footage I took earlier of the moment Reverend David Black, a regular protester outside of the Broadview Detention Center, was shot in the head with a pepper ball by ICE agents on the roof of the facility.

Since this escaping containment, I wanted to clarify a couple things.

Fascists HATE being ridiculed and often react violently—in fact Funny Frog got tear gassed, and reportedly ICE goons were trying to find ways to spray tear gas INSIDE the frog suit.

Never before in American history has one state's military force been deployed in another state over its objection.

I say never because the Civil War involved states whose governments legally ceased to exist, their offices vacated by constructive resignation, with no legitimate governors to object.

Even if they had some legitimate need and legal basis for deploying the Guard in Chicago, the only reason to not use Illinois NG for it is to cast doubt on their place in the chain of command, treating them as though they are already in mutiny or rebellion, no longer normally functioning.

Aside from shattering core state sovereignty, it's saying one state's Guard (TX) is somehow more loyal to the national authority than another's (IL). It's treating the latter as something bordering on hostile, or at least alien. One part of the country and its soldiers are more America than another.

Norms of the legal profession require professors and litigators to act in ways that are guaranteed to fail us in this moment.

I understand how constrained people must feel, & how much those norms are internalized by lawyers.

But we must have something different from our advocates and journalists.

At some point, lawyers arguing before SCOTUS must make clear - possibly even during oral argument - that SCOTUS is corrupt, led by a corrupt CJ, & acting in a manner entirely inconsistent w rule of law.

I love Madiba Dennie, & wouldn't disagree w anything said here, but this moment requires more.
