A. I believe she was in the country illegally because, one, the primary language she used -- that I heard her use was Spanish, and then to interact with everyone else was Spanish. She became a possible match on my facial recognition system. THE COURT: That system, does it say possible, likely, highly likely? Or is it a number? THE WITNESS: So it's just an image, Your Honor. And you kind of have to look at the eyes and the nose and the mouth and the lips. But nothing will give you 100 percent unless the subject is -- is fingerprinted. THE COURT: Okay. But does that app that you were using or that mobile -- THE WITNESS: It doesn't give you a percentage, Your Honor. THE COURT: But it returns a photograph? THE WITNESS: It returns a photograph. THE COURT: And then you have to determine if that -- if that photograph matches and how confident you are that it matches the person in front of you? THE WITNESS: Yes, Your Honor. THE COURT: Okay. BY MR. RATCLIFFE Q. You were continuing with your list. So, so far, you said -- A. Spanish. Q. -- she's speaking Spanish, possible match in Mobile Fortify? A. And she was in a vehicle where everyone seemed to be out of status.

So then, in order to -- to use another tool that I had to identify her, I took my government cell phone out of my pocket. It has the little facial recognition mobile query for CBP. And I took a photo -- I tried to take a photo of her face, and she looked down. So then I remember I moved her shoulder back. And she complained because I did forget she had handcuffs on and -- like, behind her back. And she kind of, like, yelped, like if I had caused pain, like a lot of pain. So then I apologized. I said (speaking Spanish), which is "I'm sorry," (speaking Spanish). And I said (speaking Spanish). I said, "I need to take your photo." So I took her photo, where she kind of looked at me. And then when I looked down at my mobile query, it came up to a very -- like, a similar person. I wasn't sure if it was her or not. It matched to someone -- I remember saying, "Maria? Like, is this Maria?" And then at that point there was other ICE agents around me. So they were like "Maria, Maria," to see if she would respond because, again, she was refusing to talk to us, which is her right. So she wouldn't -- she didn't articulate -- like, she didn't show any facial features or nonverbal -- nonverbally she didn't show us that it was her. So we told her, "Is this you? Like, are you Maria?" And she wouldn't respond. Well, we weren't sure 'cause it was like a -- it was like a maybe. And then I tried taking her photo again, and this time it came up to someone else. I can't recall the name, but we used that name as well, "Are you this person?" She looked at us. Like, I remember her eyebrows kind of like -- like, "Who are you talking about?" She gave us that look.

NEW: Defense attorneys for a Minnesota man convicted last year of dragging ICE officer Jonathan Ross are seeking access to training records and other files tied to him killing Renee Nicole Good, arguing the files could affect post-trial motions and sentencing.

The argument is that the jury instructions essentially contained a two-part decision tree: Jurors could convict Muñoz-Guatemala if they believed he should have known Ross was law enforcement. They could also convict him if they believed driving away was not a reasonable response. Muñoz-Guatemala’s conviction does not indicate which of these prongs the jury relied on. If it was the latter, the defense argues in the motion, the jurors should have access to evidence that may have bearing on Ross’s conduct, tactics, and whether he behaved aggressively—information that might indicate whether the agent has a history behaving recklessly in the field or contrary to his training.

ICE agents get a name back from face recognition and multiple agents start calling out "Maria! Maria!" to see if a woman in custody reacts. (Presumably if she does that's a match???)

It didn't work, so they ran the app again and got another name.
In Oregon testimony last year, an agent said two photos of a woman in custody taken with his face-recognition app produced different identities. The woman was handcuffed and looking downward, the agent said, prompting him to physically reposition her to obtain the first image. The movement, he testified, caused her to yelp in pain. The app returned a name and photo of a woman named Maria; a match that the agent rated “a maybe.” Agents called out the name, “Maria, Maria,” to gauge her reaction. When she failed to respond, they took another photo. The agent testified the second result was “possible,” but added, “I don’t know.” Asked what supported probable cause, the agent cited the woman speaking Spanish, her presence with others who appeared to be noncitizens, and a “possible match" via facial recognition. The agent testified that the app did not indicate how confident the system was in a match. “It’s just an image, your honor. You have to look at the eyes and the nose and the mouth and the lips.”

NEW: Records also show DHS rushed Mobile Fortify out after abandoning its own facial-recognition oversight rules. Central privacy review was sidelined under orders from a Project 2025–linked former Heritage Foundation lawyer now serving as DHS chief privacy officer.

“DHS has not publicly replaced its previous facial recognition directive, and it appears DHS has no policy or even restrictions on the use of facial-recognition technology,” says Jeramie Scott, senior counsel for the nonprofit Electronic Privacy Information Center and director of its surveillance oversight program. The directive also prohibited “systemic, indiscriminate, or wide-scale monitoring, surveillance or tracking.” It said facial recognition could not be used to “profile, target, or discriminate against individuals for exercising their constitutional rights.” It forbade the use of tools that claim to analyze people’s faces to infer personal traits and characteristics (with a narrow exception for age). It also tied any use of facial recognition by ICE and CBP to a headquarters-level review and authorization process, to be carried out by DHS’s chief privacy and information officers, respectively. Fortify was fast-tracked less than two months after Directive 026-11 disappeared, in May 2025. CBP and ICE privacy officers alone concluded that no new privacy assessment was required under federal law—an authority it did not previously possess. Records show that such determinations historically rested with the DHS senior director of privacy compliance, a headquarters official acting on behalf of the department’s chief privacy officer and independent of operational agencies.

Dallas Police Chief Daniel Comeaux says he will not share details on how often DPD interacts with ICE, rejecting a request made by the Community Police Oversight Board. Board chair John Mark Davidson made a request on January 7 to DPD to share details on its interactions with U.S. Immigration and Customs Enforcement. The request came after videos and photographs on social media showed Dallas police officers present during incidents involving ICE. But Comeaux told the board during its Tuesday meeting that sharing details would "not be in the best interest" of law enforcement. "It would not be in the best interest of law enforcement to do that right now, to let everyone know where we're going, where we might be going, how many times we might be out," Comeaux said. "It's just not the right thing to do right now." Comeaux has said that DPD would assist federal agencies. DPD has been at scenes involving ICE to "maintain the safety of all parties involved."

There’s a reason privacy advocates are fond of Sen. Ron Wyden, and its not just because he routinely champions legislation aimed at protecting civil liberties. From his perch on the Senate Select Committee on Intelligence, Wyden is uniquely well situated to spot intelligence programs that strain the limits of the law or unduly encroach on Americans’ privacy. And while Wyden takes his obligation not to reveal classified information seriously, he has a history of doing all he can to draw public attention to those potential problem areas. Long before Edward Snowden revealed the NSA’s now-defunct mass database of domestic telephone records, Wyden was sounding the alarm about a secret and radical interpretation of the Patriot Act’s “business records” provision. Most notoriously, at a public hearing in 2013, he pressed then–Director of National Intelligence James Clapper on whether NSA collected any type of data on Americans in bulk—and received the now-infamous answer “not wittingly,” which seriously weakened Clapper’s credibility when it was revealed to be false just a few months later.

After his arrest, Gibson says in his declaration that he was taken to a local detention facility where ICE agents posed for photos. “Once there, agents posed with their personal cell phones taking selfies standing on either side of me with their thumbs up,” he says. “I observed them take similar photos with other detainees.
