The council finally accepted this, wiped John’s £22,000 debt in full, and ensured he no longer had to contribute towards his social care. “I finally have the freedom to ‘maintain my health and have no debt hanging over me,” John said of the decision.

DLS’ Community Care solicitors fought for the council to recognise John’s essential disability-related expenses. We showed that every cost was tied to his health conditions, and none were covered by the NHS or social services.

The local authority – without ever having made John aware of a need to contribute towards his support – started to invoice him for these essential items, calling for £22,000 in social care contributions.

He began receiving social care in 2006 to help him manage daily living needs. To support his health conditions, John relies on a range of disability-related essentials, such as supplements and diet-specific foods that he has to purchase himself.

John survived a racial attack in 2000 that left him with severe impairments, including PTSD, depression, and bowel problems, forcing him to retire from his career.

Amina said that before she approached DLS, she felt “helpless, very anxious and depressed and confused,” and that afterwards she “felt so relieved.” She said, “I cannot thank DLS enough for all they have done to help me. They have been amazing. I am so very grateful to them.”

After DLS made a complaint on Amina’s behalf, the council finally admitted that the overpayment was due to their own error and it was written off. We were also able to get Universal Credit to make Amina exempt from bedroom tax for needing an overnight carer.

DLS requested a revision from the council and when they refused to change their decision, an appeal was submitted. But the council sat on the appeal without sending it to the Tribunal’s Service, dragging the case on from October 2024 until July 2025.
