A Constitution isn’t worth much if its clear dictate of 2+2=4 can be creatively interpreted as saying 2+2=5 by political hacks posing as impartial justices. I don’t think it’s an exaggeration to say that if Trump wins on this, America will effectively be a post-constitutional state.

Not a big believer in IQ but assuming it’s real I’m proposing a minimum 10-point deduction for a callback to the same rhetoric used against your own ancestors when they washed up here after being smeared by the British government as too stupid, lazy, and drunk to feed themselves, hence the famine.

My guess is the people pressing for an end to birthright are well aware of the many potential downsides but see a bigger upside in a world where one’s citizenship is at the pleasure of the executive, and where a Democratic President would be unlikely to use such authority even if they had it.

Must assume that *legislative* gerrymanderers were acting in good faith. Presumably this gives them an out to strike down or at least freeze California’s voter-driven redistricting.

They’re too cowardly to issue actual precedential decisions they know will be part of the law school anti-canon in 20 years so they’re trying to bully the district courts into doing their dirty work by signaling their preferences via the shadow docket, but nobody’s biting, hence the petty sniping.
