Pedantically, wouldn’t “prior to” mean that nothing else could be before that category? “Time immemorial” seems to cover everything from the Big Bang to 1189.

Probably, but that itself is bad. “Misusing the powers of the presidency to subvert the authority of the United States” moves the needle for some people. It doesn’t matter if they should have been persuaded before; convincing them now is itself worthwhile.

I’ve been thinking about Chesterton’s fence a lot recently. I can’t understand how anyone who considers themselves conservative sides with the people dropping napalm on anything resembling a gate.

“… the point of jail is to make sure people show up to court.” You get it right in the article, but this is a disappointing way to phrase this. It’s a duty of jails to get people to court on time. If we’re depriving people of their liberty just to get them to show up, that’s a bigger problem.
