The Miami Herald case is an example of what happens when a state government tried to impose a fairness doctrine like policy to entities that were not subject to such regulations to begin with, cable channels would fall under such entities.

Cable channels like Fox News, just like the Miami Herald, had nothing to do with the fairness doctrine

And the courts were already starting to question doctrine, it was in fact that the courts that ordered the FCC to review the doctrine in 1987 on constitutional questions.

Apparently showing someone the times when the court system questioned these policies in the 80s and beyond was enough to get me blocked, I hope their echo chamber is worth it.

Meredith Corp. v. FCC, 809 F.2d 863 (D.C. Cir. 1987) was the case where they ordered the FCC and Radio TV News Dir, et al v. FCC, et al, No. 98-1305 (D.C. Cir. 2000) was the court case where the court ordered the removal of the personal attack and political editorial rules.

The courts were already starting to look closely at policies like the fairness doctrine, it was the courts that ordered the FCC to review it in 1987 and they outright ordered the removal of some other similar broadcast policies in 1999/2000.

They were only two requirements of the fairness doctrine, honesty was not one of regardless of what some websites claim.

The doctrine did not require licensed broadcasters to figure out which side of an issue was being the most truthful.

And Let’s not forget that Fox News and MSNBC were started the same year. Both essentially came out out of the ruins of the America’s Talking cable channel, a channel dedicated to opinion talk shows.

Fox broadcasting stations are not broadcasting the content of Fox News, they are separate legal entities.

The FBC channels are not FNC affiliates.

Or to put in another way, the local Fox TV stations are affiliates of Fox broadcasting. They are not affiliates of Fox News.

They are completely different content and earlier this year the FCC declared that a local fox affiliate not be held responsible for the content of Fox News.

Again, just like MSNBC and the various Disney Channel cable companies.

Are you confusing Fox News with the broadcasting network FOX, it is legally different things. Just like MSNBC is different than NBC and ESPN is different than ABC.

Fox News is not a broadcaster. It is not using the public airways and it is not licensed to use them.

It certainly doesn’t support any contention about the fairness patron applying to non-broadcasters and it says nothing about other laws that would apply to non-broadcasters.

If you believe that such a law exists for cable and satellite channels you should be able to cite it.

It was created as a regulation on licensed broadcasters, there are still FCC broadcast regulations that exist even today and the government still doesn’t try to apply them to cable or satellite channels.

Such as the regulations that involve profanity or nudity.
