This is the USDOT circle of abdication next the best practices hierarchy of controls. The circle assigns the same weight to a teenager wearing a helmet or the doctor trying to save his life as the DOT with the multi-$Bn budget that designed the deadly road that resulted in the crash.

“Shared responsibility” framing assigns the same weight to the actions of 12 year old walking to school or whether a college student bikes in a foam hat as it does to a DOT with a $1Bn budget and direct control over the built environment. Responsibility scales with power. DOTs have all the power.

This lovely train and bicycle trail has approximately 8 times the carrying capacity of the equivalent amount of space devoted to car lanes. Instead of loud, polluting, dangerous, ugly-ass freeways plowing through our cities, we could have this. 🚶🚲🚉 is cheaper, safer, better.
