To give Biden his laurels, Biden on TPS and Parole was fine. Good even sometimes. Biden Parole was a great program and if he had the courage to keep going rather then getting spooked by the Know-Nothings he may have beaten Bush or Reagan on immigration.

IANAL myself but, I don't know that relying on the girls word would be reckless or negligent. After all we rely on student accounts of what would happen in a class all the time. They would have to prove they saw the paper which is tricky.
