For years and years I believed Ted Cruz was evil but brilliant, because I read a quote once from one of his liberal Harvard law professors, who said Cruz was the smartest student he’d ever had.

Then one day I looked it up and realized it was Alan Dershowitz.

Dershowitz, who no one disputes is a public figure, haspresented no evidence that CNN’s commentators or producersacted with actual malice. To begin, CNN has offered unrefutedevidence that its commentators believed in the truth of theirstatements about Dershowitz; all of the journalists testified thatthey believed their statements were fair and accurate. AndDershowitz did not counter that evidence. Instead, he repeated aboilerplate objection that the testimony was “scripted and self-serving.” Probably so. But that does not render it non-probative,and in the absence of contrary evidence, questioning the witnesses’ credibility is not enough to create a factual dispute. See Penley v.Eslinger, 605 F.3d 843, 853 (11th Cir. 2010).
