The first part of your post is a false equivalence.

Kyle originally traveled to Kenosha, where he had a secondary residence, on the 24th for work (RecPlex). Not for the riot. He spent the night at a friend's house.
He didn't decide to volunteer until later that day (25th).
No "authority" needed.
