Hemingway gave his away "to the people of Cuba", specifically by putting it in the custody of the Cuban catholic church. Arguably that's not the same as to a specific person.

This was the central point in the US's entry to WWI. It was relaxed in WWII only insofar as necessary to not excessively endanger submarine crew from enemy reinforcements.

Vessels can board and search vessels, they can arrest the crew, they can't just shoot them when they are defenceless!

In fact, EVEN in a state of armed conflict and we are talking about actual guns and weapons being smuggled through a blockade, the historical position of the US had been that in the absence of resistance and formal military status, vessels must secure the lives of the passengers and crew.
