Impunity does not change illegality. As some remedy, the world becomes smaller for those who engage in atrocities, including aggression. GWB once cancelled a trip to Switzerland over concern of possible arrest concerning past US torture practices.

Without basis in an AUMF I’d say this is less constitutionally firm than other interventions but agree it’s not “clearly unconstitutional.” As for illegality, domestic amnesties shouldn’t change the label.
