So "soliciting" leaks is not protected newsgathering, according to this administration.

Do they think leaks grow on trees? Journalists aren't stenographers who wait for the government to tell them what they can print. We wrote about this here.

We filed a brief opposing the SEC "gag rule," which bars those who settle with the SEC from talking to reporters to protect the SEC's reputation.

We shouldn't need to say this, but the government doesn't get to censor its critics to make itself look good.

The DOJ agrees with the plaintiffs here, or at least did last time they chimed in.

They’ve twice said that journalists have a constitutional right to cover protest dispersals which obviously requires them to be allowed to stay after protesters are dispersed.

This wasn't really a hard decision. As little faith as we have in institutions, we recognize the value of drawing visible lines in the sand. We drew ours personally a while ago, but better late than never.
