He could be easily criminally prosecuted, excuses be darned. Once dems eventually bounce back, congress can also subpoena him because of his roles and just drag him in front of committees, and normal accountability for him would be worse than death in his mind.

You can be sanctioned for the unauthorized practice of law in places where you aren't a lawyer though, which can lead to disbarment in all states.

Isn't just an understanding; Congress saw that this little loophole might be abused and cleared it up with the Miscellaneous Receipts Act, which requires that basically everything enter the Treasury.

Ok, but Canada could be waging a war of defense, as they have a claim of right? So one side would be waging war, but the other side can't? So it isn't a war because only one side has right to wage war. Your definition seems unworkable.

Does war require a claim of right? If the United States decided to invade Canada with the pretense "we want that land" would it not be war? So have you created a strange definition of war that doesn't include such an invasion?

We never authorized force or declared war against venezuela, so it is all illegal anyway. Everyone involved, top to bottom, should be prosecuted.
