while HI probably is fine in the recording case, in more charged cases, especially involving incorporated fed con rights, they are in a bad spot—unless they delegitimize SCOTUS. bc of the broad nature of incorp rights you can create rights conflicts and then go the wrong way w them (ie abortion)

right, but in this piece we see HI going against Bruen with a guns case—where the assertion of state power is disfavored by scotus, but ok by the state court, and is an incorporated constitutional right then you create the possibility of conflict. Combined with innovations on both sides, trouble!

more broadly though, if state courts get used to getting big mad at scotus then that could create a) normative anti-fed impetus, b) rulings that contradict scotus on fed law.

fwiw I don’t agree that this undermines the integrity of the show and while it is very silly it’s not “whenever the plot needs him to be he is”—both seldons exist within very limited contexts pursuing concrete goals by explicable and understandable means which creates drama. Its good!

I see where you’re coming from—but this film HATES Joe so much it includes a lengthy epilogue that clearly states just how awful a punishment he receives as a consequence if his actions. And it is a Divine punishment—he is not punished by law enforcement! but by harsh and perverse suffering.

the general worry is that these guys’ whole project is getting stuff done in a way that may not actually achieve social justice, but in whatever way they think is best—the new philosopher kings who may not have the patience to work with unions or other coalition members.
