The report also highlights that the UK hasn't significantly regressed from 2020 levels of env protection, alongside notable egs of progressive divergence, incl UK & Scot Govts’ decision to close sandeel fisheries – praised as a strong use of post-Brexit policy autonomy to protect biodiversity.

The report points to a widening gap in ambition and action, with the UK falling behind the EU in several critical policy areas – often ‘diverging by default’ as the EU makes ambitious updates to what was once a ‘Common Rulebook’ shared by both parties.

This morning, IEEP UK launched its annual ‘Divergence in UK/EU Environmental Policy: State of Play’ report, which tracks legislative divergence across nine different thematic policy areas since the UK left the EU.

Much could, and should, change with the Planning Bill before it is passed. And we would be interested in seeing the EUs response to its ramifications, for all the reasons the UKICE article covers.

This includes identifying and mitigating challenges caused by divergence, boosting collaboration with the EU on data sharing - for example, by rejoining the European Environment Agency - and bolstering legislation further up the waste hierarchy to reduce resource use and consumption.

Our paper calls for the UK government to address this through a strengthened vision for policy and regulation in the UK, including with the upcoming Circular Economy Strategy for England due in the autumn.

Produced together with Aldersgate Group, this new report warns that regulatory divergence between the UK and the EU on circular economy could create additional burdens for businesses, and leaves the UK market exposed to products made to low environmental standards.

New impetus is clearly needed, given the slow rate of progress in recent years, for example in expanding higher tier agri-environment schemes and establishing more tree cover. This represents a challenge for the whole of the UK and not only for England.
