I'm glad you both are as confused as I am. It makes some political sense to frame this as about qi, given that people have heard of it and think it's bad; but I don't think that's what's going on-they don't seem to understand the legal landscape (that they're fighting to change) at a basic level.

Markey's right that federal officers have qualified immunity, but the big problem for constitutional suits against federal officers is Bivens doctrine, not qi. Thank you BUT. As @stevevladeck.bsky.social recently elegantly explained, the problem with federal accountability isn’t primarily qi - its that there is no right to sue at all. Congress needs to fix that first. bsky.app/profile/stev...
