Too late to remand it back to the GJ, for a new determination of probable cause, correct? Although this judge seems like he is so offended by the level of incompetence shown in obtaining the indictment that he will probably straight up dismiss it.

I really think the statements to the effect of "Go ahead & indict him 'cause we have lots of evidence he's guilty we aren't sharing w/ you" renders the presentation "less than fair & impartial" & shows the prosc "controlling the outcome of the proceedings" which under the caselaw gets it kicked.

In general, I think that every reporter should start their question with “Mr. President, I know that you won’t like this question, and when you don’t like a question you try to bully reporters and call them names, but to do my job I need to ask you…” But calling a woman piggy makes my blood boil.

Absolutely what I have been saying. No prosecutor would want to risk her winning her appeal, getting a new trial and then being able to file a motion to dismiss on the basis that she can’t get a fair trial because of the info that was released. Not realistic, but it’s done that way in every case.

(There isn't any other evidence - the judge dismissed the case because my client didn't do what he was charged with). 3 wks ago my co-counsel & I were laughing at the argument that you can't dismiss a case because maybe something exists that you didn't have when you charged it. Funny world. 4/4

Weirdly, I have an issue like this right now - I have a BS case a judge dismissed. The prosecutor appealed, & her argument is that it can't be dismissed before trial because there could be more evidence against my client that they didn't have when they charged the case (and still don't have). 3/4

In state court you get a copy of the transcript either automatically, or if you ask. In federal court you ask the judge to review it & produce it to you. Typically judges don't find any issues and say no. Unusual to have it produced, but it happens from time to time. 2/4

I'm a lawyer. There's a transcript typed up of everything said in front of a grand jury, & if it's not a fair & accurate presentation of the evidence you ask a judge to send it back for a do over or to dismiss the case (had a case sent back to the gj because of false stmts by a cop last Friday) 1/4
