This is why the rights of the child are paramount, at international law as well as domestically. Parents don’t own kids and have no rights beyond what is best for the child. The child’s best interests are those based on evidence.

And the text of s. 90 is:

The petition, however, states: “The Constitution Act, 1867 provides the federal government, through section 90, with the authority to disallow certain provincial legislation in order to protect constitutional principles and minority rights”.

That is a separate issue, but yes - the “notwithstanding clause” has been invoked to override those rights.

I have seen this circulating and would love someone to help me with a “Constitutional Law for dummies” summary of how s.90 of the Constitution Act 1867 gives the feds this power? The summary in the petition doesn’t track the language of s. 90. Thanks.

This was absolutely laughable-out-loud funny. Glad to hear you’re interrogating this.

Sorry for taking so long to reply. My grunt-to-speech-to-text generator was glitching. Strewth!

Maybe Carney's actually just using Australian English. Did the Canadian linguists consider that? Antipodean erasure!

As a dual citizen, I'm taking a very strong interest in this. Like you say, time will tell as to which aspects of this legislation (if any) are effective. My main point in favour of the Australian government's approach is that it shows a willingness to regulate safety on social media platforms.

Honestly, though, I think the rule of law could try harder when it comes to regulating "posting a photo to your social media profile".

One of my favourite parts (and which I think should be part of mandatory civics education in school) is this cool infographic showing people how the rule of law applies to situations like "buying a coffee" or "ordering take-out": www.ourstoprotect.ca/trivia
