Today, Bijal Shah explains how the Supreme Court, during Trump's first term, deployed the Administrative Procedure Act to restrain the President’s illegal immigration actions.

This time, however, the Court has shown little appetite for such review, fueling the consolidation of presidential power.

LPE friends - CONFERENCE UPDATE!! ⏰☎️ Planning is still underway for the first annual LPE conference, launching a new LPE Association, but we're pushing the dates to FEBRUARY 5-7, 2026. We'll be putting out a CFP by August with information about how and what to submit. Until then, save the new date!

best comparative cases for these are historical: the case of colonial india after first franchise extension where elites sought to weaken capacity in the name of fairness and better governance, and the US south after reconstruction. In both cases they had “backlash coalitions” against taxation
