NEW: Judge Guaderrama rapped the administration for the "blatant lawlessness" of of the deportation and ordered the man's return by Dec. 12. The admin said it had a "tentatively scheduled" flight on Dec. 4, but it fell through.

A hearing before District Judge Sara Ellis, on the class action that sought to rein in immigration agents' use of force in Chicagoland, has just begun.

Ellis acknowledges plaintiffs' recent motion to dismiss the case, but is dealing with intervenor media orgs' interest in case materials first.
New: feds have responded to a class of press, protestors and clergy moving to dismiss their lawsuit against immigration agents' violent behavior in Chicagoland.

Calling the move "procedural gamesmanship," feds say a dismissal w/ prejudice bars the class from bringing similar claims in the future.

The NY AG's office is seeking to disqualify Sarcone and quash the subpoenas.

The judge declined to rule from the bench at the conclusion of the hour-long hearing in Albany earlier today.

But she expressed skepticism that Sarcone was lawfully appointed as acting US attorney for Northern NY.
