NEW: Rep. Dan Goldman and Brad Lander, the city comptroller, have referred the ICE officer to the Department of Justice for "felony prosecution."

The two-page referral accused the officer of using "excessive force" that deprived the victim of her Fourth Amendment rights.

NEW: A NY state judge issued a final ruling in the City Council lawsuit against Mayor Eric Adams over his attempt to let ICE into Rikers.

Judge ruled the executive order was “illegal, null, and void,” because of an “impermissible appearance of a conflict of interest."

To be clear, Ho's ruling was narrowly focused on Mr. Lopez Benitez's detention and subsequent release.

It did not impact ICE practice of conducting arrests in immigration courts.

There are at least two other lawsuits, in DC and New York, challenging courthouse arrests, though.

The judge, Lewis Kaplan, ordered ICE to reduce the number of migrants, ensure they have sleeping mats, and facilitate calls to lawyers.

BREAKING: Judge Lewis Kaplan just issued a temporary restraining order demanding that ICE hold fewer migrants at 26 Federal Plaza in New York City.

It also orders ICE to ensure they have access to lawyers and proper hygienic and medical care.
