"THE BIG FREEZE is [] radical guerrilla tactics. But I also believe that if we can’t cabin immigration enforcement away now as the known province of white nationalist Nickelback fans who are hopelessly bad in bed and never tip more than 10% that we don’t stand a chance of stopping what’s coming."
THERE IS ONLY ONE WAY TO STOP ICE NOW
it's going to take all of us, but we can all do this

NEW: Judge Immergut's says Trump's assessment of "war-ravaged" Portland was not made in "good faith" Even under a legal standard that gives the president "great deference," she said, there's no basis for "ignoring the facts on the ground."

Judge IMMERGUT, a Trump appointee to the bench, ruled that Trump's call-up was based on false claims about unrest in Portland and that Trump's own statements were "simply untethered to the facts." storage.courtlistener.com/recap/gov.us...

it is a lot more complicated than that but this isn't the place to get into it
mattcameron.bsky.social
Not on the merits--they just used it to destroy universal Injunctions on the shadow docket and then pretended that they would reach the merits someday
mattcameron.bsky.social
To say it yet again and call this shot clearly: of all of the wildly illegal second term Trump policies, the birthright citizenship EO is the one wildly illegal second term Trump policy that SCOTUS--yes, even this SCOTUS--will not abide. It is a layup, and preserves some kind of normalcy somewhere

"just because we wrote a hundred pages about this nonsense doesn't mean we're actually taking it seriously" is one of the better judicial dunks I have seen in awhile

BREAKING: The 1st Circuit Court of Appeals, in a 100-page opinion -- says it is unequivocally, lopsidedly easy to determine that the Trump administration's view of birthright citizenship is wrong.

What we just saw: state police not only assisting federal agents with crowd control out here, but also protester arrests.

All morning, this has been a nonviolent demonstration. Have not seen a single crime from this crowd (not that that would excuse the brutality).

There was a noticeable difference between “feds are in town” and “feds are in town and now being paired up with MPD units.”

They went from bumbling around on the Mall to surgical strikes in migrant neighborhoods & targeting key commuter roads for working class neighborhoods at rush hour.

this article shows how critical local partnerships are for ICE to hit their numbers, which is why you should keep the pressure on your local city governments to refuse cooperation with them

ICE had made only 85 arrests in Washington from Jan. 20 through the end of July. But from early August until mid-September, ICE made around 1,200 arrests, according to officials with knowledge of the data.

We detail how that happened:

exactly, like most legal analysis these days that "fwiw" was doing a lot of work
mattcameron.bsky.social
very cool and totally normal to not update the standing orders of 2 days prior to let us all know that!
mattcameron.bsky.social
fwiw designating it a "non-international armed conflict" actually takes things *further* from AEA territory because per the Geneva Convention it is explicitly acknowledging that TdA is non-governmental, at least as I understand the situation & controlling law so far
mattcameron.bsky.social
per the 9/29 memo they were only designated that way for detained matters, per usual for shutdowns. Did I miss some superseding guidance?
mattcameron.bsky.social
Why are non-detained removal proceedings still happening in immigration courts around the country right now? EOIR's standing orders only allow enough operations to cover detained matters. I'm sure someone is on this, but I would really very much like to know.

I have a severe and intractable sleep disorder, would be the relevant context here
mattcameron.bsky.social
the Trump administration has apparently decided to continue operating the immigration court system (an executive department within DOJ) full-speed during a government shutdown despite its own directive a few days ago that EOIR would only be handling detained cases

"Democrats have shut down the government."

This is at the top of the immigration court's website on the DOJ homepage. This is just how the government talks now.

Don't sleep on Michelle Wu, one of this country's most quietly effective climate leaders, cruising to a second term in Boston. It's telling that business interests tried and failed to stop her and are pouting about it now

as you may know this was in their order in Wilcox (NLRB firing), back in May. But Kagan (excerpt on the right) completely agrees with you fwiw
Finally, respondents Gwynne Wilcox and Cathy Harris
contend that arguments in this case necessarily implicate
the constitutionality of for-cause removal protections for
members of the Federal Reserve’s Board of Governors or
other members of the Federal Open Market Committee.
See Response of Wilcox in Opposition to App. for Stay 2−3,
27−28; Response of Harris in Opposition to App. for Stay 3,
5−6, 16−17, 36, 40. We disagree. The Federal Reserve is a
uniquely structured, quasi-private entity that follows in the
distinct historical tradition of the First and Second Banks Except apparently for the Federal Reserve. The majority
closes today’s order by stating, out of the blue, that it has
no bearing on “the constitutionality of for-cause removal
protections” for members of the Federal Reserve Board or
Open Market Committee. Ante, at 2. I am glad to hear it,
and do not doubt the majority’s intention to avoid imperil
ing the Fed. But then, today’s order poses a puzzle. For the
Federal Reserve’s independence rests on the same constitu
tional and analytic foundations as that of the NLRB,
MSPB, FTC, FCC, and so on—which is to say it rests largely
on Humphrey’s. So the majority has to offer a different
story: The Federal Reserve, it submits, is a “uniquely struc
tured” entity with a “distinct historical tradition”—and it
cites for that proposition footnote 8 of this Court’s opinion
in Seila Law. Ante, at 2 (citing 591 U. S., at 222, n. 8).
But—sorry—footnote 8 provides no support. Its only rele
vant sentence rejects an argument made in the dissenting
mattcameron.bsky.social
Expected only because in their rush to overrule Humphrey's Executor SCOTUS did specifically say that the Fed is different in kind from other independent executive agencies--and it would be the end of the US as a serious global financial power if it weren't so I can't really give them an A for this

Here’s 3 full minutes of @kaitlancollins trying to get @SpeakerJohnson to admit undocumented people can’t get federal health care, and Johnson repeating the lie over and over anyway.

Republicans are kicking people off insurance then lying about who they’re doing it to.

The democrats have a *written* spending bill. There are no tax subsidies for undocumented people to get healthcare. Republicans said there are. Which speaks to my ongoing point of you might as well do the right thing because your haters are going to lie anyway.
