Maybe. But for many, the cost of rebuilding elsewhere (in time, attention, and uncertain payoff,) is higher than the declining marginal value of staying. Not sunk cost fallacy; just different (and perhaps rational) cost-benefit analysis.

So the Supreme Court clipped nationwide injunctions and now CASA is going for class certification to achieve the same effect. Clever lawyering, but also a sign of how policy is increasingly made through procedural end-runs rather than legislation.

Sure, it’s not always 4-D chess. But dismissing everything as “just insane” risks ignoring the market incentives for insanity. Madness can be a business model. Just ask cable news.
