This has been a long time coming, but here it is: the Polish government—the same one that pledged to restore the rule of law—has just suspended the constitutional right to seek asylum. And it did so through executive action, bypassing procedures meant to regulate restrictions on human rights.

W książce wydanej z okazji 35-lecia urzędu Rzecznika Praw Obywatelskich napisałem o napięciu między ochroną czasową a trwałymi formami ochrony uchodźców (statusem uchodźcy i ochroną uzupełniającą).

It will be harsh, costly, difficult to implement (as the UK-Rwanda and Italy-Albania deals have shown) and, crucially, highly questionable from a fundamental rights perspective.

2. Extend entry bans on returned individuals;
3. Expand pre-return detention (detention to be 'proportionate', not necessarily last resort);
4. Be strict on the suspensive effect of remedies;
5. Expand possibilities to deport to states other than that of origin;
6. Limit voluntary return.

Great analysis by @alexandraancite.bsky.social. I would add one point: while one might theoretically imagine a finding of ‘no violation’ of Art. 4 Prot. 4 due to an expansive reading of the ND & NT exception, there must be a violation of Art. 3 if the Court takes its absolute character seriously.
