Hmm, reminds me of a passage I read recently in Ernst Fraenkel’s “The Dual State” about defense attorneys pushing for punishment by the “Normative State” (operating by legal norms) to keep the “Prerogative State” (arbitrary measures justified by a permanent state of emergency).
