I’m right there with you. I knew things would be exponentially worse with Trump 2.0, but he’s exceeding even my horrific vision of how things were going to go, and the speed with which it has gone. It’s incomprehensible, and I can’t even mentally digest half of it.

Okay, that makes perfect sense. Habba's and Halligan's cases are a bit different, but it seems like there isn't a lot of wiggle room for interpretation in either case; Habba overstayed her interim period, and Siebert *couldn't* be replaced by another interim just because Trump fired him.

Indeed, that part I more or less understood. The sticking point was around the idea that, if I recall, it's at the judge's discretion whether or not to invalidate Halligan's appointment, which left open the possibility that the indictment may proceed, is that correct?

There we go, THAT'S what I wanted to see. He's proven that there is merit to a vindictive prosecution dismissal, so that has a chance of succeeding. But even if it didn't, Halligan's illegal appointment should be the final nail in this case's coffin.

The judge also set an initial schedule for pre-trial motions.

The first set is expected by Oct. 12. Per Comey’s defense counsel, that batch will include motions to dismiss for selective and vindictive prosecution, as well as a motion challenging the legality of Halligan’s appointment as US attorney

CNN: The judge presiding over the prosecution of Jim Comey has agreed to Comey’s request to schedule a near term trial. Comey asked for a Jan 12 trial date. The judge went with Jan 5. Comey is counting on the gov’t not being ready for trial. A good bet.
