In short the “just appeal to the right,” strategy is much more complicated than its advocates suggest. There are practical, cultural, and moral barriers that have to be overcome.

Democrats foreground governance and policy, while Republicans foreground electioneering and messaging. It’s culturally much easier for the GOP to shift message because policy doesn’t have to follow as closely as on the Democratic side.

Additionally, inclusion and Civil Rights aren’t just political positions. For a large part of the Democratic alliance the are core values.

It would be hard for a journalist to get these records from anyone but her. Federal law protects her class work as personal information, but enterprising journalists never let the law stand in the way of a good story.

How good were her other essays? Did she obviously flunk this paper to start the lawsuit?

We all know it’s contrived, but how much pre meditation went into it? We all know she wrote a bad essay, but did she do that on purpose?

Also, it’s a 650 word essay. How much does that count against her grade? Did she sink a small assignment knowing it wouldn’t really affect her grade?

The court isn’t changing the rules though, the legislature is. The court is upholding the principle the Supreme Court says it wants to up hold.

Also, as you say, we’re as far from an election as we can get in our system.

If you’re using intention as your standard, and you’re giving the Legislature the benefit of the doubt, then you’re never going to find against the state.

Christ, that is cynical. Intention is very difficult to adjudicate. If an action disenfranchises voters, then their rights were violated. Intention doesn’t really matter.

Has anyone else noticed? He’s stopped doing rallies. A narcissist forgoing the lime light has to be pretty damn sick.

He also sits a lot in the Oval Office instead of standing like half a centaur, as in his first term.
