There is an incentive for a fixed penalty route.
But for cases where FP is inappropriate or the defendant doesn't take it the range of penalties are more severe, and the fine is unlimited (Band C is 150% weekly income)

This is already the case in the UK. There are fixed penalties for minor offences, but if you don't pay them, appeal and lose, or it's not offered then the offences fine band, plus a 40% surcharge is payable.
