Does Congress or a court need to say something violates the first amendment before a court presiding over a civil matter in equity can say so?
onbluskysku.bsky.social
By what standard is congress saying so or a court saying so a legal standard or a rational standard, when congress saying so or a (criminal) court saying so prior to a dispute about the matter is not required for other applications of constitutional amendments?
onbluskysku.bsky.social
No Amendment creates a standard. Yet somehow with the exception of the 9th we regularly apply them

Trump has been illegally bombing boats off the coast of Venezuela.

Tim Kaine and Adam Schiff forced a vote on reasserting Congress's role over war powers and ending this reckless
warmongering.

It failed 48-51.

Murkowski and Paul voted yes.

Fetterman voted no.

If they want their guard deployed they can just... already do that. 12406 is about federalization without the consent of a governor

I actually don't see them getting pepper balled here. They have the mandate of heaven

I see a lot of people saying that a person charged with a crime deserves the chance to prove their innocence.

Please stop doing this because you have it backwards and this is really important.

It is ALWAYS the government's burden to prove a person guilty beyond a reasonable doubt.

When did follow ups become verboten?

You're increasing taxes of everyone to provide some of that value back in the form of a service to people, but you only get that service if you have kids to put in a school. And you get lots from it! You get childcare, child education, sometimes reduced food costs, that non-parents don't get.
onbluskysku.bsky.social
Really? Free public schools are a measure that pressure people to have children
onbluskysku.bsky.social
This is why most robust welfare states don’t just tax the super rich. They tax moderately wealthy people heavily too, as they should! Like for example Biden’s promise to not raise taxes on earners under 400 k was just bad policy. Great politics! Terrible policy.
onbluskysku.bsky.social
For one, you didn’t discuss UBI at all. That isn’t what a pension system is. UBI is a different thing. But if you just broadly mean any cash transfer system that sends money to low income earners, I also didn’t say you can’t do it. You can! You just need broader efforts to push down inflation
onbluskysku.bsky.social
I didn’t say they shouldn’t pay their fair share. That aside what’s fair shouldn’t matter for policy. They should pay more whether or not it’s fair, because it’s good for democracy. It’s just not useful for controlling the speed of private spending since rich people have low marginal util of capital
onbluskysku.bsky.social
These are identical actions but fwiw yes as a meme the former sounds better. If everyone pays x in taxes and people with kids get to pay x minus a in taxes or get a rebate or a deduction to pay x minus a, this does the same thing as making everyone pay x minus a except people without kids who pay x

MMT suggests that doing revenue-raising taxes on just rich people would be pretty strongly inflationary. That doesn't mean not to do them for non-revenue purposes but it does mean you can't use that to fund a bunch of low income pensioners without seeing demand spike for goods and push prices up.

Why not just structure this as a strong negative tax on people with children, thereby avoiding all the harm of confiscation from people for not having children while still creating the same benefits to offset the burden of having kids for people who do?
onbluskysku.bsky.social
States don't collect federal taxes though

Again, Sliwa over Cuomo if it really came down to that. Thank god for Mamdani

In short: Sliwa is running the race I'd expect. Having a good time, enjoying the spotlight, running to grab as big a share of the electorate as he can, happy to hurt Cuomo, offering himself as what he is—his own unconventional mix of far-right activist and NYC lifer and sui generis weirdo.
