A doctor cried on the stand when her colleague, who is South Asian & did not want to be involved in the tribunal, was named by Sandie's lawyer during cross examination.

This was shortly before these jokes became public so it put her in a tough spot when she was asked why she was so upset by it.

Our hope is that this will insulate her as she, very deservedly, moves forward with her life.

Regardless of how involved Beth has to be in the case, we will be fascilitating well wishes for the immediate future. 🌸

We encourage you to listen to the smart legal minds within our community (not us!) to understand the weight of gender critical arguments on subjects like corrections of misattributed wording before reacting to them.

This has been an extraordinarily long and convoluted tribunal from the start & there has been only a few short days to digest the judgement, which itself acknowledges the possibility of appeal.

If this press conference goes ahead today, it will be far from the final word.

Beth Upton was a second respondent - Sandie Peggie wanted her to be found liable for A LOT of charges alongside NHS Fife.

You might be thinking of Rose Henderson, who is not a respondent but who also was accused very publicly of behaviour she denied in court, after a slew of media coverage.

A lot of the publicly available information is available through CC or TT, and it can be really hard to put together a full picture but we suspect that particular part of the claims might be decided based on whether or not the judge feels that this was adequate as a temporary solution.

We had volunteers monitoring the case - the 'storage cupboard' was a separate room from where they were expected to change but it didn’t have enough lockers & they only offered a single cubicle (and that was in a separate office) for all the women who wanted to change separately.

Similar arguments were made by Jo Pheonix in the Darlington Nurses tribunal as well.

It got extremely nasty (esp in the press) but Rose Henderson did really well under cross examination.

A witness testified that Rose has already been moved to a changing room elsewhere though, notably without the same fascilities (shower etc) that she had previously.

We completely agree. The consequences of the privacy applications being denied in these cases are extremely predictable.

We need the judicial system to catch up and take the risks to trans people seriously from the start.

We ask that, when you see a serious allegation against a trans person in the press, you remember Dr Upton's case.

We all have a right to be heard in court and judged on the merits of what we have actually done, not the perceptions of people who cannot see the good in us.

Beth was accused of sexual harassment. Sandie Peggie's version of events, which was found not to be credible, painted her as an instigator who tried to get her fired for saying no.

Rose Henderson has endured months of media coverage commenting on her body, underwear & alleged behaviour.

Beth has received a disproportionate amount of attention as a result of Sandie Peggie's cases but similar tribunals have been taking place for years.

We can do right by Beth by learning some of the common tactics used in these tribunals and applying that knowledge going forward.

Beth has seen the cards that have made their way back to us so far and appreciates the solidarity. Her privacy is a huge priority so we will be speaking generally going forward.

These campaigns will not win any legal fights (Beth’s legal team had that in hand!) but they really matter.

Sandie Peggie has at least two more cases pending - one against her union and two against NHS Fife that she is seeking to amalgamate into one case.

Whether she chooses to appeal or not, she will be in the news for a while yet.

Dr Beth Upton and her loved ones deserved their privacy. We condemn the way she was maligned in the press and on social media as a result of this case.

They found that Beth Upton is a credible witness. She did not try to victimise Sandie Peggie for holding gender critical beliefs or try to get her fired and 'answered all the questions in a calm and considered manner' during stressful cross examination. All the claims against her were dismissed.
