We say "the winners write history" in cases where the losers got completely wiped out and ceased to contribute to history, and yeah that happens sometimes. We sure don't have much Carthaginian writing. But most of the time the losers do get a say! Sometimes their narrative wins!

I should moderate my language. The laws aren't insane. Americans are insane. The rational reaction to "trucks are no longer affordable and cost $75,000 for a Child Mulcher" is "okay I won't buy a truck," and they did not anticipate the reaction of "a seven-year loan at 12% APR sounds great to me!"
