Today marks the end of our #Section230 30th Anniversary campaign! As Section 230 enters its fourth decade, Congress faces a choice: either pursue thoughtful reform that addresses real harms, or pursue wholesale repeal that would silence the very voices it claims to protect.

The rise of #generativeAI has coincided with alarming reports of harm to kids from interacting with online chatbots. But #Section230 repeal wouldn't mitigate these harms – especially since AI outputs are not covered by the law anyway.

#Section230 turned 30 yesterday! Over the past few weeks, we've explained what the law does, highlighted positive outcomes it enables for independent creators & marginalized voices, established our principles for evaluating reform, and explored what thoughtful changes could look like.

Keeping #Section230 as is would be politically untenable, but thoughtful reform can address real harms without incentivizing platforms to silence speech or creating barriers that only #BigTech can overcome.

There are many issues with current proposals to reform and repeal #Section230 of the Communications Decency Act, all of which could have serious repercussions for freedom of expression online. But what would good reform look like?

Before assessing the #Section230 reform proposals currently circulating in Congress, it's important to articulate ourbaseline principles. Any Section 230 reform worth pursuing must protect free expression while addressing real platform harms.

Congressional lawmakers from both sides of the aisle are gearing up for #Section230 repeal, but this could mean an end to social media as we know it.

Section 230 isn't just a liability shield for online platforms - it's also essential for news journalism and freedom of expression online. Read more in the breakdown from @mwils.bsky.social in her latest blog post:

Although @publicknowledge.bsky.social believes outright repeal of #Section230 is the wrong move, that doesn't mean we think it's perfect or untouchable. While Section 230 shields platforms from liability for hosting third-party speech & allows for content moderation without fear of lawsuits…

Calls from congressional leaders to repeal #Section230 aren't new – and Public Knowledge's position isn't either. Back in 2024, @housecommerce.bsky.social introduced legislation to "sunset" the law by the end of 2025, which would have had serious consequences for our free expression online.

#Section230 is both one of the most important and most misunderstood pieces of legislation that affect the internet. As its 30th birthday approaches, read the breakdown from @bergmayer.net on what exactly this law does – and why repeal is the wrong approach.
