I might be naive, but I don't think "it's better to ask for forgiveness than permission" is good government policy, and talking down to people who suggest otherwise is bad

The real problem with Humphrey's Executor is that it sounds like a wizard spell and not a legal precedent. What do you mean our government order is partially upheld by Tenser's Transformation? What's protecting gov employees is Galder's Tower? That SCOTUS is striking down Otiluke's Freezing Sphere?
